Processing and Delivery

Published prices for parts exclude delivery and handling. These charges are billed separately.

Part orders requiring expedited processing at the customer’s request for same day delivery are subject to a $125 fee plus delivery charge quoted by Baxter at the time of order placement.

General Warranty

Parts warranties extend only to the original customer, and are not assignable or transferable.

Baxter warrants that the parts it manufactures shall be free from defects in material and workmanship when delivered to the original customer.

Baxter warrants that the parts it manufactures, when used in accordance with the directions on the labeling, are fit for the purposes and indications as described in the labeling.

Parts distributed by Baxter are warranted by their manufacturer. More specific warranties may accompany these parts.

Unless the part is used in accordance with its instructions, the part warranties are void and of no effect. There are no other expressed or implied warranties, including any warranty of merchantability of fitness for a particular purpose. Baxter shall not be liable for incidental or consequential damages.

Baxter's sole obligation, and customer’s exclusive remedy for breach of any warranty, shall be, at Baxter's option, to repair or replace the part.

Returned Goods Policy

This policy applies to all parts originally delivered to hospitals, centers or other customer locations unless otherwise indicated. See Specific Return Situations below.

Parts must be stored in accordance with the following Baxter storage requirement to be eligible for return or credit:

  • Stored at the originally delivered site, in the original, unopened, and undamaged carton or package.
  • Stored in a sanitary manner.
  • Stored to avoid liquid contamination.
  • Stored at room temperature to avoid excessive heat or freeze damage.

 

Parts provided at no charge are not eligible for credit.

Prior notification to return parts is required. Credit will not be issued without prior notification of the return.  Baxter shall have no responsibility or liability for parts returned without prior notification.

Specific Return Situations

Damages or shortages:
Baxter must be notified of any shipping disputes within two (2) business days of receipt. Due to the nature of Baxter’s parts, the contents are subject to damage in transit to the customer. In an effort to minimize any delay in resolving a damage or shortage claim, all orders will be deemed counted and inspected upon customer’s acceptance of delivery from the carrier. Any exception must be noted on customer's copy of the carrier’s packing list and freight bill or bill of lading. The carrier must countersign the packing list and freight bill of lading. The signed packing list and freight bill or bill of lading must be forwarded by the customer to Baxter Credit and Collections. Please call 1-888-270-3189 to obtain the proper mailing address.

Shipped in Error by Baxter

Baxter must be notified of any shipping disputes within two (2) business days of receipt. Parts shipped in error by Baxter must be returned within thirty (30) business days of shipment to receive 100 percent credit. Contact Customer Service to arrange for the return of such parts. Parts returned after thirty (30) business days of shipment shall be considered excess stock (see section below on Excess Stock).

Ordered in Error by Customer

Baxter must be notified of any shipping disputes within two (2) business days of shipment. Parts ordered in error by customer must be returned within thirty (30) business days of shipment to receive credit. Customer is responsible for all costs and expenses incurred by Baxter related to the return of the parts. Parts returned after thirty (30) business days of shipment date shall be considered excess stock (see section below on Excess Stock).

Excess Stock

Parts not shipped in error, or not ordered in error, shall be considered excess stock when returned.

Customer is responsible for all costs and expenses incurred by Baxter related to the return of excess stock.

Parts returned from a hospital, center or other customer location will be credited at 50 percent.

Parts will not be eligible for return or credit under the following circumstances:

  • Less than three (3) months remaining on an expiration date.
  • Sold on a no return basis.
